Terms and Conditions

Effective date: January 1, 2025

These Terms and Conditions ("Terms") govern all rentals and services provided by San Porta Potty("San Porta Potty," "we," "us," or "our") to customers ("you" or "Customer") in San Diego, CA and the surrounding service areas. By requesting a quote, placing an order, or accepting delivery of any equipment, you agree to these Terms.

1. Rental Period & Scheduling

Rental periods, delivery windows, and pickup dates will be confirmed at the time of booking. We make every effort to deliver and pick up equipment on the agreed dates, but delivery times may shift due to traffic, weather, site access issues, or other circumstances beyond our control.

2. Site Access & Placement

Customer is responsible for ensuring our delivery truck has safe, clear access to the placement location and for identifying any underground utilities, septic lines, or hazards. Units must be placed on level, stable ground. Additional fees may apply for difficult site access, excessive distance from the truck, or relocation requests after delivery.

3. Care of Equipment

Customer agrees to use rented units for their intended purpose only and to prevent damage, vandalism, or misuse during the rental period. Customer is responsible for the full replacement cost of any unit that is lost, stolen, or damaged beyond normal wear and tear while in their possession.

4. Payment

Full or partial payment may be required to confirm a booking, with the balance due on or before delivery unless otherwise agreed in writing. Recurring service accounts will be billed according to the schedule outlined in their service agreement. Late payments may result in suspended service or additional fees.

5. Cancellations

Cancellations made with reasonable advance notice may be eligible for a full or partial refund of any deposit. Cancellations made shortly before a scheduled delivery may not be refundable, particularly for event rentals where equipment and routing have already been allocated.

6. Limitation of Liability

To the fullest extent permitted by law, San Porta Potty is not liable for indirect, incidental, or consequential damages arising from the use of rented equipment. Our liability for any claim related to a rental is limited to the amount paid for that specific rental.

7. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time of your order governs that transaction.
